By accessing or using Haircolor Drop ("Service"), operated by BeauBar LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Products and Services

4.1 Hair Color Products

Our products are professional-grade hair color formulations. By purchasing and using our products, you acknowledge:

• You will perform a patch test 48 hours before full application as directed
• Hair color products may cause allergic reactions in some individuals
• Results may vary based on your starting hair color, condition, and application technique
• You are responsible for following all provided instructions

4.2 AI Consultation

Our AI-powered consultation provides recommendations based on the information you provide. These recommendations are not a substitute for professional colorist advice. For complex color corrections or concerns, we recommend consulting a licensed professional.

5. Subscriptions

If you subscribe to our Service:

• You authorize us to charge your payment method on a recurring basis
• Subscription fees are billed in advance on a recurring basis (every 4, 6, or 8 weeks as selected)
• You may cancel at any time; cancellation takes effect after the current billing period
• No refunds are provided for partial subscription periods
• We reserve the right to change subscription pricing with 30 days notice

6. Orders, Shipping, and Returns

6.1 Orders

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason.

6.2 Shipping

Shipping times are estimates only. We are not responsible for delays caused by carriers or circumstances beyond our control. Risk of loss passes to you upon delivery to the carrier.

6.3 Returns and Refunds

First-time customers may request a full refund within 30 days of delivery if unsatisfied with results. For subsequent orders, we offer formula adjustments at no additional cost. Products must be unused to qualify for a return. Contact support@beaubar.com for return authorization.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, and software, are the exclusive property of BeauBar LLC and are protected by copyright, trademark, and other intellectual property laws. 8. User Content

By uploading photos or other content to our Service, you grant us a non-exclusive, royalty-free, worldwide license to use, store, and process such content solely for the purpose of providing our Service. You represent that you have the right to upload such content and that it does not violate any third-party rights.

9. Disclaimer of Warranties

THE SERVICE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) results from the Service will be accurate or reliable; (c) products will meet your specific expectations; or (d) any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAUBAR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO HAIR DAMAGE, ALLERGIC REACTIONS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless BeauBar LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Governing Law and Disputes

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in any court of competent jurisdiction.

YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
